Refund and Withdrawal Policy

1. Who sells chAIr and who this applies to

chAIr is operated by Scaling Legal ehf. (kt. 430325-0510), Hvannhólmi 16, 200 Kópavogur, Iceland, hello@chair.is. Subscriptions are sold through our reseller, Paddle (Paddle.com Market Ltd), which is the seller of record and handles payments and refunds.

chAIr is a service for companies. The Icelandic Consumer Contracts Act (lög nr. 16/2016 um neytendasamninga) protects consumers, that is individuals buying for purposes outside their trade or business, so it does not normally apply to a company's subscription. We nevertheless give every customer the rights set out below, which are at least as favourable as the withdrawal rights under that Act. If you are a consumer, the Act applies in full and nothing in this policy limits it.

2. Right to withdraw (14 days)

You have the right to withdraw from your subscription within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract was concluded, that is the day you started your subscription (including the free trial).

In addition, you can ask for a full refund of any subscription payment within 14 days of that payment, including renewals, without giving a reason.

To meet the deadline, it is enough that you send your notice before the period ends.

3. How to withdraw or ask for a refund

Tell us of your decision with a clear statement, for example:

• by email to hello@chair.is with your company name and the date of the order or payment, or
• through paddle.net, where you can find your order with the email address you paid with, or
• by letter to Scaling Legal ehf., Hvannhólmi 16, 200 Kópavogur, Iceland.

You may use the model withdrawal form below, but you do not have to. We confirm receipt of your notice by email without delay.

4. Refunds

If you withdraw, we refund all payments received from you for the subscription, without undue delay and at the latest 14 days after we receive your notice. The refund is made by Paddle to the payment method you used, unless you have expressly agreed otherwise, and you do not pay any fees for it. The time it takes for the money to appear on your statement depends on your bank or card issuer.

The law allows a seller to charge a consumer a proportionate amount for service provided before withdrawal when the consumer asked for the service to start during the withdrawal period. We do not charge this: you receive a full refund even though you were able to use chAIr.

5. Free trial

New subscriptions start with a 5-day free trial. You are not charged during the trial. If you cancel before the trial ends, you are never charged. If you do not cancel, the first monthly payment is taken when the trial ends, and you can still withdraw or ask for a refund as described above.

6. What happens to your subscription and records

When you withdraw or a payment is refunded, the subscription ends and access to chAIr stops. Please export any records you need first (Profile & Settings → Data & Account → Export Data). After the subscription ends we keep your company's data for 30 days and provide an export on request, as described in section 11 of our Terms of Service.

7. Cancelling without a refund

Outside the periods above you can cancel at any time. The cancellation takes effect at the end of the billing period you have paid for, and you keep access until then (Terms of Service, section 11).

8. Complaints and your other rights

If something is wrong with the service, contact us at hello@chair.is and we will try to resolve it. This policy does not limit any rights you have under applicable law or under Paddle's buyer terms and refund policy. Consumers in Iceland may also refer disputes to the Icelandic Complaints Committee on Goods and Services (Kærunefnd vöru- og þjónustukaupa).

Áskriftir eru seldar í gegnum endursöluaðilann Paddle (Paddle.com Market Ltd) sem annast greiðslur og endurgreiðslur. Þjónustan er ætluð fyrirtækjum og lög nr. 16/2016 um neytendasamninga gilda að jafnaði ekki um kaup fyrirtækja, en við veitum öllum viðskiptavinum þann rétt sem lýst er hér að neðan. Séu kaupin neytendakaup gilda lögin að fullu.

Réttur til að falla frá samningi

Þú hefur rétt til að falla frá þessum samningi án þess að tilgreina nokkra ástæðu innan 14 daga. Frestur til að falla frá samningnum rennur út 14 dögum eftir þann dag sem samningurinn var gerður. Auk þess getur þú óskað eftir fullri endurgreiðslu á hvaða áskriftargreiðslu sem er innan 14 daga frá greiðslunni.

Til þess að nýta réttinn til að falla frá samningnum þarft þú að tilkynna okkur (Scaling Legal ehf., Hvannhólmi 16, 200 Kópavogi, hello@chair.is) ákvörðun þína um að falla frá samningnum með ótvíræðri yfirlýsingu (t.d. með bréfi sendu í pósti eða tölvupósti). Nota má staðlaða eyðublaðið hér að neðan, en það er ekki skylda. Til að fresturinn teljist virtur nægir þér að senda tilkynningu um að þú neytir réttar þíns til að falla frá samningi áður en fresturinn rennur út.

Áhrif þess að falla frá samningi

Ef þú fellur frá þessum samningi munum við endurgreiða þér allar greiðslur sem við höfum fengið frá þér. Endurgreiðsla fer fram án ástæðulausrar tafar og ekki síðar en 14 dögum eftir að okkur berst tilkynning um að þú fallir frá þessum samningi. Við munum endurgreiða þér með því að nota sama greiðslumiðil og þú notaðir í upphaflegu viðskiptunum, nema þú hafir samþykkt annað sérstaklega. Þú þarft ekki að bera neinn kostnað af þessari endurgreiðslu. Við innheimtum ekki greiðslu fyrir þá þjónustu sem veitt var áður en fallið var frá samningi.
